These Terms & Conditions ("Terms") govern access to and use of CommentLink (commentlink.co), an Instagram and WhatsApp automation platform operated by Squadkin Technologies Pvt Ltd ("CommentLink", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
The Service
CommentLink helps businesses automate and manage conversations on Instagram and WhatsApp Business using Meta's official APIs. Features may include keyword and comment automations, story reply flows, a shared team inbox, contacts, broadcasts, analytics, and related tools we make available from time to time.
We may add, change, or remove features. We do not guarantee that any particular feature will remain available indefinitely.
Eligibility and accounts
- You must be able to form a binding contract and use the Service for a legitimate business purpose.
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding login credentials and for activity under your account.
- If you invite teammates, you are responsible for the access you grant and for their compliance with these Terms.
- Notify us promptly at support@commentlink.co if you suspect unauthorized access.
Connecting Meta channels
To use Instagram or WhatsApp features you must connect accounts you are authorized to manage through Meta's official login. You represent that you have the right to grant CommentLink the permissions requested, and that your use of those channels complies with Meta's Platform Terms, Instagram Terms, WhatsApp Business terms, and related policies.
CommentLink does not store your Meta passwords. Tokens and identifiers are used only to operate the Service you configure. You may disconnect channels at any time; doing so may stop automations and message delivery for those channels.
Your content and customer data
You retain ownership of content you upload and of data about your contacts and conversations. You grant CommentLink a limited license to host, process, transmit, and display that data solely to provide and improve the Service for you.
You are responsible for the messages, media, and automations you send; for obtaining any required consents; and for complying with applicable privacy, consumer, and messaging laws in the places you operate.
Acceptable use
You agree not to use the Service to:
- Send spam, unsolicited bulk messages, or messages that violate Meta or WhatsApp messaging policies.
- Harass, defraud, impersonate, or harm others, or promote illegal activity.
- Distribute malware or attempt to probe, disrupt, or overload the Service.
- Reverse-engineer, scrape, or bypass rate limits, security, or access controls except as allowed by law.
- Resell, sublicense, or provide the Service to third parties as your own product without our written consent.
- Use unofficial Instagram/WhatsApp access methods, scraped sessions, or anything other than Meta's official APIs via CommentLink.
We may suspend or terminate accounts that create risk for Meta channel health, other customers, or the platform.
Fees
CommentLink is currently provided free of charge. We do not collect payment card details for CommentLink usage and we do not charge subscription fees today.
Meta may charge you directly for WhatsApp conversation or messaging fees under your own WhatsApp Business / Meta billing relationship. Those fees are between you and Meta. We do not resell, collect, or mark up Meta messaging fees.
If we introduce paid CommentLink plans later, prices and billing terms will be published before any charge, and you will be able to choose whether to continue on a paid plan.
Third-party platforms and availability
The Service depends on Meta APIs, internet providers, and other third parties. We are not responsible for outages, API changes, policy enforcement, account restrictions, or rate limits imposed by Meta or other third parties. Delivery of comments, DMs, and broadcasts can fail for reasons outside our control.
Intellectual property
CommentLink, including its software, design, branding, and documentation, is owned by Squadkin Technologies Pvt Ltd and protected by intellectual property laws. These Terms do not transfer ownership of our IP to you. You may not copy, modify, or create derivative works of the Service except as needed to use it as intended.
Confidentiality
Each party may receive non-public information from the other. You agree to use our confidential information only to use the Service, and we agree to use yours only to provide it, except where disclosure is required by law.
Suspension and termination
You may stop using CommentLink and disconnect channels at any time. We may suspend or terminate access if you breach these Terms, if required by law or by Meta, or if continued use risks harm to the Service or others. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including IP, liability limits, and indemnity) will survive.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AUTOMATIONS WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY MESSAGE WILL BE DELIVERED.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SQUADKIN TECHNOLOGIES PVT LTD AND COMMENTLINK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR COMMENTLINK IN THE THREE MONTHS BEFORE THE CLAIM, OR (B) USD $50 — WHICH, WHILE THE SERVICE IS FREE, MEANS LIABILITY IS LIMITED TO USD $50 EXCEPT WHERE LAW DOES NOT ALLOW SUCH A LIMIT.
Indemnity
You will defend and indemnify Squadkin Technologies Pvt Ltd against claims arising from your content, your messaging practices, your automations, your violation of these Terms, or your violation of Meta policies or applicable law.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and disconnect your channels.
Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India will have exclusive jurisdiction, except where mandatory consumer protections in your country require otherwise.
